AGI conference: L’expertise privée comme moyen de preuve

Why attend?

Since 1 January 2025, private expert opinions have been officially recognized under Swiss law as evidence—i.e., as a means of proving facts presented by the parties.

This represents a major development:

• The statement of a private expert is no longer considered a mere party assertion but a true means of proving the relevant facts invoked.
• Challenging an expert opinion carried out according to professional standards now requires the production of evidence with equal probative value.
• This recognition is particularly significant in construction-related disputes, where technical issues play a central role.
